These Terms of Service constitute a legally binding agreement between you ("User") and Black Pixel AI Inc. ("Company") governing the use of the website everstory.pro and related services (the "Services").
By accessing or using the Services, you confirm your full acceptance of these Terms. If you do not agree with any provision of these Terms, you must not use the Services.

2. Description of Services
The Company provides a service for creating, storing and printing personalized memory books ("Memory Book Service"). A memory book is a digital and/or printed photo book in which each photo is accompanied by a written story. EverStory uses AI to draft an initial story for each photo, which the User then edits and completes with their own details. The completed book can be kept digitally on the User's EverStory account or ordered in print.
The Company reserves the right to modify, suspend, or discontinue any part of the Services at any time.
3. Eligibility
Only individuals who are at least 18 years old may use the Services. By using the Services, you confirm that you meet this requirement and have full legal capacity to enter into this agreement.
4. User Content and License
You retain full ownership of any photos and text that you upload to the Services ("User Content"). By uploading such content, you grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, enhance, print, store, and deliver such content solely for the purpose of fulfilling your order, providing customer support, performing quality control, and enabling reprints.
The Company shall not use your identifiable User Content for advertising or promotional purposes without your explicit written consent.
5. Payments
Digital memory books are available free of charge, with a free storage limit per account as described on our website. Printing of a memory book is a paid service. Pricing for printing and shipping is shown to the User at checkout, before payment is completed, and may vary by destination country.
All payments are processed through Stripe or other authorized payment processors. Production and shipping of a printed memory book begins only after full payment has been successfully completed.
6. Shipping, Production & Customs
Printing: All printed memory books are produced at our own printing facility located in Poland in a single fixed size (20×20 cm hardcover).
Production time: Each book is printed and prepared for shipping within a few business days from the moment payment is confirmed.
Delivery times (counted from dispatch date, not order date):
- Israel: typically 10–14 business days from confirmation of the final version.
- European Union: typically 7–14 business days from confirmation of the final version.
- Other countries: shipping is available worldwide; estimated delivery times are shown at checkout.
Customs and import duties (DDU — Delivered Duty Unpaid): The product price and shipping fee do not include customs duties, import taxes, or brokerage fees. These are the responsibility of the recipient and are paid upon receipt. We recommend reviewing potential customs costs before placing an order.
Tracking: All shipments include a tracking number, which is sent to the User by email once the order is dispatched.
7. Storage of User Content and Repeat Orders
User Content, including photographs, text and project data, is stored on the User's EverStory account for the purposes of creating, editing, and reprinting memory books. Free storage is provided up to the limit described on our website. Additional storage may be granted as a bonus when the User purchases a printed book. The Company may delete content earlier upon the User's written request.
8. Cancellation & Refund Policy
Cancellations and refunds are governed by our separate Refund Policy, which forms an integral part of these Terms.
9. Prohibited Content
The User agrees not to upload any content that is illegal, infringes intellectual property rights, contains sexual content involving minors, promotes violence or hatred, contains malware, or otherwise violates applicable law. The Company reserves the right to refuse processing of any order that violates these rules.
10. AI and Automated Processing Disclaimer
The User acknowledges and agrees that the Services involve automated processing and artificial intelligence (specifically: AI-generated draft stories for each uploaded photo, and AI-based enhancement of photos before printing). The drafts are intended as a starting point for the User to edit; the User is solely responsible for the final content of the memory book. The visual and textual results may vary due to technical limitations. The Company does not guarantee any specific artistic or visual outcome beyond technical compliance with the order specifications.
11. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, the Company's total liability for any claim arising out of or related to the Services shall not exceed the total amount actually paid by the User for the relevant order.
13. Indemnification
The User agrees to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and partners from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from the User's violation of these Terms, misuse of the Services, or infringement of any third-party rights, including intellectual property rights.
14. Termination
The Company reserves the right to suspend or terminate the User's access to the Services at any time, without notice, in the event of a violation of these Terms or applicable law.
15. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the State of Delaware, United States of America. Any disputes shall be resolved exclusively in the state or federal courts located in the State of Delaware.
16. Amendments
The Company reserves the right to modify these Terms at any time. Updated Terms become effective upon publication on the website. Continued use of the Services after publication constitutes acceptance of the updated Terms.
